This English translation is provided for convenience. The French version is the legally binding one. Read the French version (CGV).

General Terms and Conditions of Sale and Use (CGVU) – Platform Offer – Webradio.ai

PREAMBLE

These General Terms and Conditions of Sale and Use (the “CGVU” or “Terms”) govern access to and use of the services offered by Webradio.ai, a company specialising in the creation, automation and broadcasting of AI-assisted local webradios.

These Terms constitute a contract between the company Webradio.ai (hereinafter “Webradio.ai”, “we”, “our”) and any legal entity or professional subscribing to one of our services (hereinafter the “Client” or “you”).

By signing a quotation, creating an account or using the Platform, you acknowledge that you have read, understood and accepted these Terms without reservation. If you do not accept them, you may not access our services.

1. DEFINITIONS

1.1. Platform: the SaaS solution published and operated by Webradio.ai, enabling the complete creation, scheduling, broadcasting and management of a local webradio.

1.2. Platform Offer: all the services offered by Webradio.ai enabling the Client to manage a digital radio station, including broadcasting, automatic content generation, schedule management and premium modules.

1.3. Client: any local authority, business, association or organisation that has taken out a Webradio.ai subscription.

1.4. User: a natural person holding an account giving access to the Platform, authorised by the Client.

1.5. Client Content: all files, texts, sounds, music, podcasts, images, data or other items created, downloaded or imported by the Client via the Platform.

1.6. AI-generated Content: any content produced automatically by the artificial intelligence tools built into the Platform (chronicles, station promos, scripts, voice tracks, station imaging, etc.).

1.7. Client Account: a personal administration area enabling the Client to manage its services, its users and its invoices.

1.8. Services: all the features described in article 3.

1.9. Contract: the whole formed by the quotation approved by the Client and these CGVU.

2. USE OF THE SERVICES

2.1. Licence of use
Subject to compliance with these Terms, Webradio.ai grants the Client a personal, non-exclusive, non-transferable right, limited to the term of the Contract, to use the Platform solely within the scope of its internal and professional activities.

2.2. Development of the services
The Services evolve over time. Webradio.ai reserves the right to add, modify or withdraw features, with or without notice, in order to improve the Platform.

2.3. Availability
The Platform is accessible 24 hours a day, 7 days a week, except for interruptions for maintenance, force majeure or technical incidents. Webradio.ai does its utmost to ensure optimal availability.

3. DETAILED DESCRIPTION OF THE FEATURES

The Platform includes, without limitation, the following modules:

3.1. Scheduling and broadcasting

Creation of customisable programme schedules (day / time / theme).
Automated audio broadcasting 24 hours a day.
Management of music playlists (smart rotation, import, categories).
Insertion of jingles, station promos and chronicles.
Integration of external audio streams (other radio stations, partner programmes).

3.2. Content generation

Automatic chronicles: local news, weather, events calendar, alerts, news flashes.
Automatic station imaging (intros, beds, transitions, outros).
Creation of editorial content from text or RSS feeds.
AI generation of audio scripts based on thematic templates.

3.3. Interaction and engagement

Song dedications and listener messages.
Polls, votes and mini-competitions.
Playback of pre-recorded messages or messages sent via a web form.

3.4. Podcasts and Replay module

Automatic recording of broadcast programmes.
Hosting and generation of share links.
Integration of the player into the Client’s website or mobile application.

3.5. Statistics and analysis

Real-time audience tracking.
Listening analysis (average duration, peak hours, devices used).
Download statistics for podcasts and on-demand content.

3.6. Music library (included)

Access to an internal music library made up of royalty-free tracks, AI-generated tracks or commercial tracks subject to a SACEM/SPRE licence.
Use exclusively within the Client’s radio station.

3.7. Administration

Client area with access to invoices, quotations and subscription settings.
Management of users and their roles.
Built-in technical support (chat, email).

3.7. Security and hosting

Automatic data backup.
Hosting on GDPR-compliant European servers.
Encrypted connections (HTTPS / SSL).

3.9. Premium options (on quotation)

Creation of bespoke jingles and station imaging.
Recording of voice tracks by professional voices.
Development of a customised mobile application.
Built-in, customisable radio player.

4. ACCOUNTS AND USER ACCESS

4.1. Each User must have their own personal login credentials.

4.2. The Client is responsible for the confidentiality and use of the login credentials.

4.3. Webradio.ai reserves the right to suspend any account suspected of fraudulent use.

4.4. Access is strictly limited to the Client’s authorised staff or partners.

5. PRICES, INVOICING AND PAYMENT

5.1. The prices of the Platform Offer are set by quotation, according to the size of the project, the volume of services and the options chosen.

5.2. Payments are made by bank transfer on receipt of the invoice.

5.3. Any late payment entails:

the application of penalties (3 × the legal interest rate),
a fixed indemnity of €40 for recovery costs,
the suspension of access to the Platform.

5.4. Webradio.ai may revise its prices at each renewal, with 30 days’ notice.

5.5. No refund will be made in the event of early termination, unless otherwise agreed in writing.

6. INTELLECTUAL PROPERTY AND BROADCASTING RIGHTS

6.1. Ownership of the Platform
Webradio.ai retains full ownership of the software, interfaces, source code, models and all technical elements making up the Platform.

6.2. Ownership of content
The Client remains the sole owner of its Client Content and of the content generated by artificial intelligence.

6.3. Licence of use
Webradio.ai grants the Client a non-exclusive, non-transferable licence to use the Platform, strictly within the scope defined by the contract.

6.4. Responsibility for broadcast content
The Client is solely responsible for the content broadcast via its webradio (texts, sounds, music, voices, audiovisual extracts, etc.) and for compliance with copyright, neighbouring rights and image rights.

6.5. SPECIFIC CLAUSE – MUSIC RIGHTS (SACEM / SPRE / SCPP / SCPA)

6.5.1. Legal obligations
Any public or private broadcast of music protected by copyright or neighbouring rights requires the payment of royalties to the competent bodies, in particular:

the SACEM (Société des Auteurs, Compositeurs et Éditeurs de Musique – the French society of music authors, composers and publishers),
the SPRE (Société pour la Perception de la Rémunération Équitable – the French society for the collection of equitable remuneration),
the SCPP and the SCPA for certain phonogram producers.

6.5.2. Client’s responsibility
The Client expressly acknowledges that it is solely responsible for complying with these legal obligations.

It is the Client’s responsibility:

to register its webradio with the SACEM and the SPRE,
to pay the broadcasting royalties applicable to its music programming,
to keep available to these bodies the broadcast logs, should they request them,
to comply with the conditions set out in the licence agreements concluded with these bodies.

6.5.3. No transfer of liability
Webradio.ai acts solely as a technical service provider for hosting and automation.

It holds no rights in the works broadcast and assumes no liability in relation to music broadcasting licences or authorisations.

The Client indemnifies Webradio.ai against any claim, fine, penalty or proceedings brought by the aforementioned collective management organisations.

6.5.4. Royalty-free content
Where the Client broadcasts only royalty-free music or music composed for its own use, it must be able to prove its origin (invoice, exploitation licence, assignment agreement).

6.5.5. Suspension of service in the event of breach
In the event of a proven breach of the obligations to register with the SACEM or the SPRE, Webradio.ai reserves the right to suspend access to the Platform until the situation is regularised, without refund.

6.6. CLAUSE – MUSIC LIBRARY MADE AVAILABLE

6.6.1. Nature of the service
Webradio.ai makes available to its Clients, at no additional cost, a music library that may be used exclusively within the Platform.

6.6.2. Composition
The library may include:

royalty-free tracks,
AI-generated tracks with a commercial licence,
commercial tracks subject to the SACEM/SPRE, which may only be used by Clients licensed by these bodies.

6.6.3. Client’s responsibility
The Client is solely responsible for the use it makes of this library.

It must ensure that its SACEM/SPRE licence covers the broadcasts made.

Webradio.ai cannot be held liable for any use outside the legal framework.

6.6.4. Restricted use
Files from the library may not be extracted, redistributed or exploited outside the Platform.

7. AI-GENERATED CONTENT

7.1. Content produced by the AI tools is provided as editorial assistance.

7.2. The Client remains responsible for checking its accuracy and compliance before broadcast.

7.3. Webradio.ai does not guarantee the truthfulness, completeness or neutrality of automatically generated content.

8. PERSONAL DATA

8.1. Webradio.ai acts as a processor on behalf of the Client and applies the GDPR.

8.2. Data is hosted in the European Union and is never sold.

8.3. The Client remains responsible for the data collected from its listeners (statistics, forms, polls).

8.4. Webradio.ai undertakes to comply with its Privacy Policy and to ensure the security of the hosted data.

9. SUPPORT, UPDATES AND MAINTENANCE

9.1. Technical support is available by email and chat from Monday to Friday, 9 am to 7 pm.

9.2. Functional and corrective updates are included in the subscription.

9.3. Occasional interruptions may be scheduled for maintenance.

10. CONDUCT AND PROHIBITED USES

10.1. Prohibited Uses: You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

In any way that breaches any applicable national or international law or regulation.
To exploit, harm or attempt to exploit or harm minors by exposing them to inappropriate content or otherwise.
To transmit, or procure the sending of, any advertising or promotional material, including any “spam”, “chain letter” or any other similar solicitation.
To impersonate Webradio.ai, a Webradio.ai employee, another user or any other person or entity.
In any way that infringes the rights of others, or in any way that is unlawful, threatening, fraudulent or harmful, or in connection with any unlawful, fraudulent or harmful activity.
To restrict or inhibit anyone’s use or enjoyment of the Service, or to harm Webradio.ai or users of the Service or expose them to liability.

10.2. Other Prohibitions: You also agree not to:

Use the Service in any manner that could disable, overburden, damage or impair the Service or interfere with any other user’s use of the Service, including their ability to engage in real-time activities through the Service.
Use any robot, spider or other automatic device or process to access the Service for any purpose, including monitoring or copying any material on the Service.
Use any manual process to monitor or copy any material on the Service, or for any other unauthorised purpose, without our prior written consent.
Use any device, software or routine that interferes with the proper working of the Service.
Introduce any viruses, Trojan horses, worms, logic bombs or other material that is malicious or technologically harmful.
Attempt to gain unauthorised access to, interfere with, damage or disrupt any part of the Service, the server on which the Service is stored, or any server, computer or database connected to the Service.
Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
Take any action that may damage or falsify Webradio.ai’s rating.
Otherwise interfere with the proper working of the Service.

10.3. Free offer – limited use of content
Under a free offer or promotional access, content generated by the Client may not be used, publicly broadcast or commercially exploited without the express written consent of Webradio.ai. Any unauthorised use, including publication online or on social networks, is strictly prohibited and may result in the immediate suspension of access to the services as well as legal proceedings in the event of infringement of Webradio.ai’s rights.

10.4. Unauthorised use of content – Free Offer
In the event of use, broadcasting, publication or exploitation of content generated under the Free Offer without the prior written authorisation of Webradio.ai, the Client undertakes to pay Webradio.ai a fixed indemnity of 1,000 euros excluding VAT per established infringement, without prejudice to any further action for damages that Webradio.ai may bring.

The Client acknowledges that this compensation clause is necessary to compensate for the loss suffered by Webradio.ai in the event of illegitimate exploitation of its free services for personal, commercial or promotional purposes.

11. TERM, RENEWAL AND TERMINATION

11.1. The contract is concluded for the term stated in the quotation (by default: 12 months).

11.2. It is tacitly renewed for equivalent periods, unless terminated in writing 60 days before the expiry date.

11.3. Webradio.ai may terminate without notice in the event of non-payment or serious breach of the Contract.

11.4. The Client may terminate its subscription by letter or email with acknowledgement of receipt.

11.5. Content remains downloadable for 30 days after termination.

12. LIABILITY

12.1. Webradio.ai is bound by an obligation of means (best-efforts obligation) in making the Platform available.

12.2. Its liability is limited to the total amount paid by the Client during the last twelve (12) months.

12.3. The Client indemnifies Webradio.ai against any third-party action relating to the content broadcast, including actions brought by the SACEM, the SPRE or any other collective management organisation.

12.4. Webradio.ai cannot be held responsible for the lawfulness, relevance or compliance of the content broadcast.

13. FORCE MAJEURE

Neither Party may be held liable for a failure due to a force majeure event (network failure, fire, war, pandemic, etc.).

14. CHANGES TO THE TERMS

Webradio.ai may update these Terms at any time.

New versions will be published on the website and notified to the Client by email at least 30 days before they come into force.

Continued use of the Platform constitutes acceptance.

15. APPLICABLE LAW AND JURISDICTION

These Terms are governed by French law.

Any dispute relating to their interpretation or performance will be submitted to the competent courts of Paris (France).

1. Definitions

1.1. Platform: Webradio.ai, a SaaS solution dedicated to the creation, management and broadcasting of local, professional or personal webradios.

1.2. Studio Offer: a premium Webradio.ai service enabling the production and editing of audio chronicles, jingles and AI-generated audio content, including the recording, editing, broadcasting and archiving of audio files.

1.3. Client: any local authority, business or individual that has subscribed to the Studio Offer in order to use the Platform.

1.4. User: any person authorised by the Client to access the Studio Offer.

1.5. Client Content: all data and content (text, audio, etc.) imported, created or generated by the Client on the Platform.

1.6. Credit: a credit is a unit of measurement used to generate audio content on the Webradio.ai Studio platform. Each credit corresponds to 3 seconds of audio produced.

1.7. AI-generated Content: any content (text, audio or other formats) created using the Platform’s artificial intelligence features.

1.8. Contract: the contractual whole comprising these CGVU and the Client’s subscription confirmation.

1.9. Studio Services: all the features and services provided under the Studio Offer, in particular the generation of chronicles, voice tracks, jingles and audio content.

2. Purpose

These CGVU govern access to and use of the Webradio.ai Studio Offer, which includes the production of audio chronicles, jingles, voice tracks and AI-generated content.

3. Subscription, payment and invoicing terms

Definition of a credit
A credit is a unit of measurement used to generate audio content on the Webradio.ai Studio platform. By default, 1 credit equals 3 seconds of audio produced, whatever the type of content: jingles, voice tracks, chronicles, etc. However, for “advertising spot” productions, the following specific rule applies: 1 credit = 1 second of audio. This distinction reflects the denser, more targeted production work required for this format.

Monthly subscription plans
Webradio.ai Studio offers monthly subscriptions based on a system of credits that can be used to generate audio files:

Starter: 300 credits — €29.00 / month
Essentiel: 1,000 credits — €69.00 / month
Pro: 1,800 credits — €99.00 / month
Avancée: 3,600 credits — €159.00 / month
Studio+: 4,800 credits — €199.00 / month

Credits are allocated each month according to the subscription taken out and are automatically carried over to the following period as long as the subscription remains active.

Use and consumption of credits
Credits can be used to generate all types of audio content offered by Webradio.ai Studio. Consumption depends on the type of format and the duration of the audio file generated.

Standard formats (jingles, voice tracks, chronicles, etc.): ➝ 1 credit = 3 seconds
Specific “advertising spot” format: ➝ 1 credit = 1 second

Examples of consumption:

6-second jingle → 2 credits
15-second voice track → 5 credits
2-minute chronicle (120 sec) → 40 credits
30-second advertising spot → 30 credits

Carry-over of credits: unused credits are automatically carried over to the following period as long as the subscription is active.

Expiry of credits: if the subscription is cancelled, any remaining credits are lost.

3.1. Subscription options: the Studio Offer is available through a paid subscription, taken out on a monthly or annual basis, with no minimum commitment.

3.2. Automatic renewal: the subscription is automatically renewed on its expiry date, unless written notice of termination is sent to Webradio.ai at least thirty (30) days before the end of the current period.

3.3. Changes to the services: any change to the Studio Services (addition of features, increase in storage volume, access to premium media libraries, etc.) may result in additional charges, subject to the Client’s approval.

3.4. Payment methods: the plan subscription and additional options are payable by credit or debit card (Visa, Mastercard, American Express). The Client’s card number and expiry date are entered on a secure server that guarantees the confidentiality of the data.

3.5. Liability: Webradio.ai cannot be held liable in the event of fraudulent use of the means of payment used.

3.6. Invoicing: on receipt of the request for a subscription and/or options, a request to debit the bank account is sent to the paying institution. The subscription and/or options are deemed to be concluded as soon as the paying institution’s authorisation to debit the account is received.

3.7. Cards not accepted: Electron, Maestro and e-CB cards and prepaid CB cards are not accepted.

3.8. Invoices: the Client is invoiced:

Every month on the anniversary date of the subscription for a monthly subscription.
Once a year on the anniversary date of the subscription for an annual subscription. Invoices are issued in the Client’s name and are accessible exclusively via the application. Clients can view and download their invoices at any time by going to the “Billing” tab in the application menu. Webradio.ai does not send invoices by email or by any other external means of communication. It is the Client’s sole responsibility to consult its invoices and billing details within the application.

3.9. Payment: for payments by debit or credit card, the Client will be automatically debited the predefined amount each month until it cancels the subscription and/or options in accordance with the conditions set out in the General Terms and Conditions of Sale.

3.10. Non-payment/Late payment: if the bank refuses a card transaction or if another means of payment is refused, the subscription and/or options will not be finalised, and the Client must contact Webradio.ai customer service to settle the payment using another means of payment. Webradio.ai reserves the right to suspend or cancel the subscription and/or options without incurring any liability. Where applicable, payments due up to the anniversary date of the subscription and/or options will become immediately payable.

3.11. Free trial: Webradio.ai may, at its sole discretion, offer a subscription with a free trial for a limited period (“Free Trial”). You may be required to enter your billing information to sign up for the Free Trial. If you enter your billing information when signing up for the Free Trial, you will not be charged by Webradio.ai until the end of the Free Trial period. At the end of the Free Trial period, unless you cancel your subscription, you will automatically be charged the applicable subscription fees for the type of subscription you have selected. At any time and without notice, Webradio.ai reserves the right to (i) modify the Terms of Service of the Free Trial offer, or (ii) cancel this Free Trial offer.

3.12. Changes to fees: Webradio.ai, at its sole discretion and at any time, may change the subscription fees for subscriptions. Any change to subscription fees will take effect at the end of the current billing cycle. Webradio.ai will give you reasonable prior notice of any change to subscription fees to give you the opportunity to cancel your subscription before the change takes effect. Your continued use of the Service after the change to subscription fees takes effect constitutes your agreement to pay the modified subscription fee amount.

3.13. Refunds: under the Terms of Service, the Client acknowledges and accepts that it has no right of withdrawal. However, Webradio.ai reserves the right to grant exceptional refunds to its Clients if the Client asks Webradio.ai in writing to cancel its subscription at the following address: contact[@]webradio.ai and if this request is received by Webradio.ai:

Within seven (7) days of the subscription date for a monthly subscription.
Within thirty (30) days of the subscription date for an annual subscription. Cancellation requests upon renewal of the subscription are also accepted if they are received by Webradio.ai under the same conditions as those mentioned above, namely:
Within seven (7) days of the anniversary date of the subscription renewal for a monthly subscription.
Within thirty (30) days of the anniversary date of the subscription renewal for an annual subscription. Cancellation requests that meet the conditions mentioned above will result in a full refund of the Client’s subscription. If the conditions mentioned above are not met, cancellation requests will be processed by Webradio.ai, but no refund will be granted to the Client. The Client may submit a cancellation request for its options at any time, in writing, to the following address: contact[@]webradio.ai. Options will be terminated on the anniversary date of the option concerned. However, the Client acknowledges and accepts that no refund will be granted for the cancellation of options.

4. Use of content and licences

4.1. Exploitation rights: the Client remains the owner of the content it creates via the Studio Offer. However, it grants Webradio.ai a hosting and broadcasting right limited to the performance of the Contract.

4.2. Legal obligations: the Client undertakes to comply with the laws in force relating to copyright and the rights of rights holders, in particular by fulfilling its obligations towards the SACEM, the SPRE or any other competent body.

4.3. Prohibition on resale: the Client may not resell or redistribute content produced via the Studio Offer without the prior written consent of Webradio.ai.

4.4. Free offer – limited use of content
Under a free offer or promotional access, content generated by the Client may not be used, publicly broadcast or commercially exploited without the express written consent of Webradio.ai. Any unauthorised use, including publication online or on social networks, is strictly prohibited and may result in the immediate suspension of access to the services as well as legal proceedings in the event of infringement of Webradio.ai’s rights.

4.5. Unauthorised use of content – Free Offer
In the event of use, broadcasting, publication or exploitation of content generated under the Free Offer without the prior written authorisation of Webradio.ai, the Client undertakes to pay Webradio.ai a fixed indemnity of 1,000 euros excluding VAT per established infringement, without prejudice to any further action for damages that Webradio.ai may bring.

5. Hosting and security of files

5.1. Webradio.ai provides secure hosting of the audio files (chronicles, jingles, voice tracks) and written content generated via the Studio Offer, ensuring that access is reserved solely for authorised Users.

5.2. Retention of files: files are retained for the entire term of the Contract. In the event of termination, files will be accessible for retrieval for thirty (30) days, after which they will be permanently deleted.

6. Confidentiality and data protection

6.1. Webradio.ai undertakes not to exploit the Client’s audio files and audio content for commercial purposes or for training artificial intelligence models, unless the Client explicitly agrees.

6.2. GDPR: personal data contained in audio files and audio content (recorded voices, interviews, etc.) is processed in accordance with the regulations in force, in particular the GDPR.

7. AI content generation

7.1. AI features: the Studio Offer includes artificial intelligence features enabling the automatic generation of texts, such as chronicles, scripts and other written content. This content is designed to be used as a basis or inspiration for the Client’s audio productions.

7.2. Client’s responsibility: the Client is responsible for checking the accuracy and relevance of AI-generated content before any broadcast or use. Webradio.ai cannot be held liable for errors or inaccuracies in automatically generated content.

8. Support and technical assistance

8.1. The Studio Offer includes priority technical support available via email and online chat, from Monday to Friday, 9 am to 7 pm (local time).

9. Commercial references

9.1. Unless otherwise stated in writing, the Client authorises Webradio.ai to use its name and logo as a commercial reference.

9.2. Publication of Content: with the Client’s consent, Webradio.ai may publish extracts of productions made with the Studio Offer for promotional purposes.

10. Term and termination

10.1. Interruption of the Service: the Client may stop the service at any time, with no minimum commitment.

10.2. Termination for Non-Compliance: if the Client fails to comply with its contractual obligations, Webradio.ai may terminate the Contract after a formal notice that has remained without effect for fifteen (15) days.

10.3. Retrieval of Files: in the event of termination, all the Client’s files will be deleted thirty (30) days after the effective date of termination, unless an express request for retrieval is made before that deadline.

11. Applicable law and jurisdiction

11.1. These CGVU are subject to French law.

11.2. Competent Jurisdiction: any dispute will be subject to the exclusive jurisdiction of the courts of Paris.

12. Intellectual property

12.1. Protection of Content: the elements on the Platform, including icons, logos and other visual content, are protected by intellectual property laws and are the exclusive property of Webradio.ai.

12.2. Use of Content: the Client undertakes not to copy, modify, distribute or use protected content without the prior written authorisation of Webradio.ai.

13. Limitation of liability

13.1. Exclusion of Warranties: Webradio.ai does not guarantee that the Services will be error-free or permanently available. The Client uses the Services at its own risk.

13.2. Limited Liability: Webradio.ai will not be liable for any indirect, incidental, special, consequential or punitive damages resulting from the use of or inability to use the Services.

14. Changes to the terms

14.1. Webradio.ai reserves the right to modify these CGVU at any time. Changes will take effect as soon as they are published on the Platform.

14.2. Notification of Changes: the Client will be informed of changes by email or via a notification on the Platform. Continued use of the Services after the changes are published will constitute acceptance of the new terms.

15. Communication

15.1. Newsletter Subscription: by creating an account on the Platform, the Client agrees to receive newsletters, marketing or promotional communications and other information from Webradio.ai. The Client may unsubscribe at any time by following the unsubscribe link in the emails.

17. Use of data

17.1. Use of Data: Webradio.ai will use the data provided by the Client exclusively to improve the functionality of the platform, refine algorithms and train the associated artificial intelligence systems. Under no circumstances will Webradio.ai sell, rent or share the data with third parties for reasons not expressly mentioned in this agreement.

17.2. Deletion of Data: users retain the right to request the deletion of their data from Webradio.ai’s systems. On receipt of such a request, Webradio.ai will take immediate steps to delete the data concerned, subject to the retention of certain anonymised data sets, which may be kept exclusively for the purposes of AI training and system optimisation. This anonymised data will be stripped of any information that could personally identify users.

18. Prohibited uses

18.1. Prohibited Uses: You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

In any way that breaches any applicable national or international law or regulation.
To exploit, harm or attempt to exploit or harm minors by exposing them to inappropriate content or otherwise.
To transmit, or procure the sending of, any advertising or promotional material, including any “spam”, “chain letter” or any other similar solicitation.
To impersonate Webradio.ai, a Webradio.ai employee, another user or any other person or entity.
In any way that infringes the rights of others, or in any way that is unlawful, threatening, fraudulent or harmful, or in connection with any unlawful, fraudulent or harmful activity.
To restrict or inhibit anyone’s use or enjoyment of the Service, or to harm Webradio.ai or users of the Service or expose them to liability.

18.2. Other Prohibitions: You also agree not to:

Use the Service in any manner that could disable, overburden, damage or impair the Service or interfere with any other user’s use of the Service, including their ability to engage in real-time activities through the Service.
Use any robot, spider or other automatic device or process to access the Service for any purpose, including monitoring or copying any material on the Service.
Use any manual process to monitor or copy any material on the Service, or for any other unauthorised purpose, without our prior written consent.
Use any device, software or routine that interferes with the proper working of the Service.
Introduce any viruses, Trojan horses, worms, logic bombs or other material that is malicious or technologically harmful.
Attempt to gain unauthorised access to, interfere with, damage or disrupt any part of the Service, the server on which the Service is stored, or any server, computer or database connected to the Service.
Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
Take any action that may damage or falsify Webradio.ai’s rating.
Otherwise interfere with the proper working of the Service.

19. Accounts

To benefit from the Services, Users must subscribe as described in the General Terms and Conditions of Subscription and create an Account.

To create an Account and be able to use the Services, Users must click on the link “https://studio.webradio.ai/register”. They are then asked to enter an email address and set a unique, personal password giving access to the Services and/or their Account.

Webradio.ai encourages Users to use “strong” passwords, combining numbers, letters and symbols as well as upper- and lower-case characters.

Users are solely responsible for safeguarding their account credentials. Accordingly, they undertake to keep them confidential and not to disclose them in any form whatsoever. If any element of the account credentials is lost or stolen, Users must inform Webradio.ai immediately, which will cancel and/or update the account credentials concerned.

Users are fully responsible for the confidentiality of their password. In this respect, they must ensure at the end of each session that they have actually logged out of the Website and/or the Application, in particular when accessing the Website from a public computer.

If they lose their password, Users can request a new password via their Account by clicking on the “forgotten password” link. In addition, Users must complete a form with the following information:

Mandatory fields are marked with an asterisk (*).

Users must then click on the “Sign up” tab.

Users will then receive an email confirming that their account has been created and explaining the Services. When creating an Account (whether for themselves or on behalf of a third party), Users undertake to provide true, accurate, up-to-date and complete information, in particular regarding their identity, in accordance with article 6-II of French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy. Accordingly, they undertake not to create a false identity likely to mislead Webradio.ai or third parties and not to impersonate another legal entity or natural person.

Webradio.ai has no control over the accuracy or reliability of the information provided by Users and therefore cannot be held liable for the consequences resulting from the provision of incomplete or incorrect information. Users who discover that another person has used their identity to access the Services must inform Webradio.ai immediately at the following address: contact[@]webradio.ai.

If a User provides false, inaccurate, erroneous, outdated, incomplete, misleading or deceptive information, Webradio.ai may, immediately and without notice or compensation, suspend or terminate that User’s Account and temporarily or permanently bar them from accessing the Website and/or the Application and/or the Services.

Furthermore, Webradio.ai cannot under any circumstances be held liable in the event of non-performance or partial performance of the subscription in connection with the provision of such information.

Registered Users may decide to deactivate their Account at any time, in accordance with the conditions set out in the General Terms and Conditions of Sale.
